A 16-year-old Sudanese girl was lashed 50 times after a judge ruled her knee-length skirt was indecent, her family said today.
The mother of Christian teenager Silva Kashif said she is to sue police and the judge who imposed the sentence under Islamic shariah law.
Saying she only learned about her daughter's conviction after she had been lashed, mother Jenty Doro said the family's religion should have been taken into account.
Kashif, whose family comes from the south Sudanese town of Yambio, was arrested while walking to the market near her home in the Khartoum suburb of Kalatla last week, Doro told Reuters.
'She is just a young girl but the policeman pulled her along in the market like she was a criminal. It was wrong,' said Doro.
Doro said Khashif was taken to Kalatla court where she was convicted and punished by a female police officer in front of the judge.
'I only heard about it after she was lashed. Later we all sat and cried ... People have different religions and that should be taken into account' she said.
Kashif's lawyer Azhari al-Haj said he was preparing a case against the police and judge for arresting and sentencing an under-age girl. He said according to the law, people under 18 should not be given lashes.
'She was wearing a normal skirt and blouse, worn by thousands of girls. They didn't contact a guardian and punished her on the spot.'
Al-Haj said he was hoping to win compensation and to clear Kashif's record. 'We are also against the law itself. We want the law to be changed.'
The case will add fuel to a debate already raging over Sudan's decency laws after this year's high-profile conviction of Sudanese U.N. official Lubna Hussein, who was briefly jailed for wearing trousers in public.
Hussein, a former journalist who used her case to campaign against Sudan's public order and decency regulations, is touring France to publicise her book about the prosecution.
She had faced the maximum penalty of 40 lashes but was given a lighter sentence.
Arrests for indecency, drunkenness and other public order offences are not uncommon in Khartoum which is governed by Islamic sharia law.
But the punishment of residents of the capital originating from the south remains a sensitive issue.
Sudan is supposed to be working to soften the impact of sharia for southerners living in Khartoum under a 2005 peace deal that ended decades of north-south civil war.
The deal lifted sharia law in the south, where most follow Christianity and traditional beliefs.
Women's groups argue the decency laws are too vague, giving the country's separate public order police too much freedom to decide what kind of dress is appropriate.
Nigerian football star Stephen Worgu this month said he had been sentenced to 40 lashes after being wrongly convicted of drunk driving in Khartoum. The sentence has been postponed pending an appeal.

Zoo-keepers in China say their tigers have grown so tame that they're frightened of the chickens they're supposed to eat.
The Chongqing Wild Animal Park has five rare adult white tigers which were originally trained to perform tricks for visitors, reports the Chongqing Morning Post.
Keepers have been trying to encourage them to follow their natural instincts by throwing them live chickens - but without success.
Feeder Shi Ruqiang said: They're supposed to be wild and scary, but due to their soft lifestyles and human care they have gradually lost their wild nature.
"I have been trying to interest them with live chickens but it was quite a funny scene. The tigers were so scared that they wouldn't go near them.
"One chicken passed out and the tigers did eventually approach it - but then it woke up again and squawked and they ran for their lives!"

Shi says the keepers are now forcing the tigers to stay outside their cages for at least 12 hours a day to toughen them up.
And they are planning to introduce a wild tiger to show the domesticated big cats the ropes.
"If all else fails, we will simply cut down their rations until they are so hungry that they are forced to hunt for themselves," he added.

During his lesson, he didn’t feel good and went to a hospital, where he was advised an immediate hospitalization.
But he refused, telling that his students would miss maths lessons and there was no one to replace him.

Prince William has spent a night sleeping rough to understand the plight of the homeless at Christmas. 
He stayed out in temperatures as low as minus 4c, lying in a central London alleyway surrounded by wheelie bins.
The Prince, patron of the charity Centrepoint, said he was trying to 'do his bit' to help the vulnerable.

He was slightly better off than the average rough sleeper, as he was accompanied by his armed personal protection officer, his private secretary - a former SAS officer - and the chief executive of the homelessness charity.

Even the venue, a secluded spot close to Blackfriars Bridge in the City, was carefully chosen for safety.
And he did have the prospect of a big lunch at Buckingham Palace the next day to keep his spirits up.

But the Prince said afterwards that the experience had helped to deepen his understanding of life on the streets. 

In a statement today, William, 27, said: 'I cannot, after one night, even begin to imagine what it must be like to sleep rough on London's streets night after night.
'Centrepoint's work - along with many other organisations' - in tackling these fundamental causes is desperately important if we are ever to end homelessness in this country. I hope that by deepening my understanding of the issue, I can help do my bit to help the most vulnerable on our streets.' 

His brief brush with homelessness came on Tuesday last week when, shortly before midnight, he walked with his sleeping bag to the spot.
The second in line to the throne was accompanied by his right-hand man at St James's Palace, former SAS officer Jamie Lowther-Pinkerton, one of the Scotland Yard police protection officers who accompany him everywhere and Seyi Obakin, chief executive of Centrepoint, a charity which works with young homeless people. 
Dressed in jeans, trainers, a hooded sweatshirt and beanie hat, he went unrecognised as he laid a piece of cardboard down on the floor and climbed into his sleeping bag.
It wasn't an altogether new experience for former Army officer William, who has often lived rough on exercises.
But it certainly wasn't a pleasant one, as temperatures plunged, making sleep almost impossible. 
Mr Obakin told the Mail: 'William asked whether there was anything he could do to help understand what our young people go through. 

'I thought on my feet and came up with the thing that I thought he was least likely to do. To my surprise, he said yes. We took as much precaution as possible - finding a relatively secluded spot in an alleyway, shielded partly by a collection of wheelie bins. 
'But there was no shielding from the bitter cold, or the hard concrete floor, or the fear of being accosted by drug dealers, pimps or those out to give homeless people a kicking. I have never been happier to welcome the break of dawn!'  After sleeping fitfully, William rolled up his sleeping bag at 6am and walked through the streets for 45 minutes, stopping to talk to several homeless people on the way.
He went to Centrepoint's hostel in Greek Street, Soho, where he showered before cooking breakfast for some of the residents and cutting a cake to celebrate the charity's 40th anniversary.

Later that day he joined the Queen for her traditional family Christmas lunch at Buckingham Palace. 

Mr Obakin said: 'He understood, as I did, that what he experienced was just a fraction of what it truly means to be homeless and afflicted.'
Carl Hughes, 28, who sleeps rough in the Blackfriars area, today praised the Prince's efforts.
'He seems like a good guy and at least he is trying to see how the other half live,' he said. 'But it takes a lot longer than a day. Still if it helps to raise the problems we face, then that's good.'
